Bill Cosby faces retrial on sexual assault charges

18 June 2017

After a mistrial was declared in Bill Cosby's sexual assault case, a member of Cosby's public relations team read a heated statement from the comedian's wife, Camille Cosby.

Cosby had been accused of sexually assaulting Andrea Constand at his Philadelphia mansion in 2004.

Many prosecutors still agree to try only the sexual assault and rape cases that they know they can win. Each of the three counts of aggravated indecent assault against Cosby carries a maximum 10-year prison term, though the counts could be merged at sentencing if he is convicted. Neither the judge nor attorneys said they were aware of how the jury split on Cosby's guilt or innocence.

Nevertheless, Cosby's legal and publicity team emerged onto the front steps of the courtroom triumphant. "Round two may be just around the corner and this time, justice may prevail".

She condemned the district attorney as "heinously and exploitatively ambitious", the judge as "overtly arrogant", lawyers for the accusers as "totally unethical" and "many" in the media as "blatantly vicious".

O'Neill and Cosby's lead lawyer, Brian McMonagle, clashed on Friday, with the defense attorney complaining that the jury was essentially getting a replay of the entire trial. "I think the first line of the obituary changes", says longtime entertainment journalist and ESPN correspondent Chris Connelly. "But why keep costing these citizens millions of dollars?"

Ruddy agrees that the move would be a wrong move, but dismissed the investigation Mueller is overseeing. The president might also assert that proper cause exists to fire Mueller.

Meanwhile, Ms Constand doled out hugs to her mother, prosecutors and some of the other women who say the TV star drugged and abused them.

Andrea Constand settled her lawsuit against Cosby a decade ago, so the specific facts of her case are not in play in the civil arena.

"There was no pause or hesitation about that, and we're moving forward", he told reporters. Under Pennsylvania's speedy trial law, the new trial should be set within 365 days, and Steele has promised to move as fast as possible. That right is essential to our criminal justice system, and the standard of evidence that must be met for a criminal conviction is by necessity quite high.

Although almost 60 women have publicly accused Cosby of sexual assault - charges his legal team has vehemently denied - only the allegations of Andrea Constand have led to criminal charges. But in most of those cases, the statute of limitations had expired by the time the women told their stories publicly.

Smolla said the outcome of any civil case would depend on how jurors behave in terms of how seriously they take the case, how they relate to one another and how they deal with holdout jurors. I just hope she turns that on Bill Cosby.

He did not take the stand in his own defence, leaving it to his attorney to argue Cosby and Ms Constand were lovers sharing a consensual sexual encounter. Now, Cosby's wife Camille has spoken out in a prepared statement.

All told, the deliberations, which began on Monday, have lasted approximately 52 hours - longer than the trial testimony. A judge agreed, unsealed them, and the documents provided pieces of a damning depositions of Cosby. The judge then declared a mistrial. He was the star of the wildly popular The Cosby Show and a successful stand-up comic. "Mr. Cosby's power is back".

In Philadelphia, where he grew up, Cosby was a hometown hero.

In the wake of the mistrial CNN Anchor Jake Tapper posted a statement from another of Cosby's accusers on his Twitter feed. Then Constand's allegations drew attention in 2005.

"She has shown such courage through this, and we are in awe of what she has done", Steele said. Nearly a decade passed, and no criminal charges were filed.
