Montgomery County defense lawyers comment on lengthy Cosby jury deliberations

22 June 2017

The jury of seven men and five women were bused in from Allegheny County near Pittsburgh and have been sequestered in a hotel for the trial.

So far, the jurors have deliberated some 26 hours since Monday evening without reaching a verdict.

"You've sent word: You're exhausted", said Judge Steven O'Neill, dismissing the panel until Wednesday morning.

Prosecutors say the famed comedian drugged and sexually assaulted Andrea Constand, the director of operations for Temple University's women's basketball team, at his home near Philadelphia in January 2004.

The prosecution rested its case on Friday, four days after the trial began. Cosby did not testify and the defense only called a single witness.

He said he was attracted to Ms. Constand the first time he met her and the two discussed her personal life, including a makeover and how her "butt" looked.

For now, the 38-year-old is not thinking about the possibility that Cosby could be found guilty, saying she'll "cross that bridge when I come to it". "A verdict of guilty or not guilty", said Fitzpatrick, "must be unanimous".

Judge O'Neill did not allow the woman, Marguerite Jackson, to testify during Cosby's defense, ruling her statements inadmissible as hearsay.

Jackson said that she asked Constand if she had filed charges.

Later outside on the courthouse steps, Constand's lawyer Dolores Troiani claimed that Jackson's statement was "absolutely not true". Their deliberations, which have stretched 16 hours, will resume Wednesday morning.

Besides Constand, the fourth day of the trial on Friday, June 9, was attended by two other Cosby accusers, Victoria Valantino and Linda Kirkpatrick.

It is unclear what prompted his detention, but he has been charged with hostile criminal acts with an aim to subvert the country. Warmbier, 22, a University of Virginia student, died Monday in Cincinnati, less than a week after his release from North Korea.

Currently, seven women have defamation suits pending in MA, while three more have defamation or sexual battery suits pending in California.

Prosecutors have portrayed Cosby as a serial predator. "It wasn't hostile. She didn't push me away, she said stop and I stopped". Constand, who is gay, maintains that the sexual conduct was not consensual.

The case was handed to the jury on Monday evening (12Jun17), and during the third day of deliberations on Wednesday (14Jun17), Pulliam appeared on US breakfast show Today to further discuss her reasons for publicly backing Cosby, who pleaded not guilty to three counts of aggravated indecent assault. "In the Cosby case", said Fitzpatrick, "the defendant testified at a deposition in a related civil suit". Cosby, his lawyer said, never ran from talking to police, for better or worse.

Defense attorneys argued that the sexual contact was part of a consenting relationship between Cosby and Constand.

Nonetheless, the comedian whose storytelling artistry fueled a $400 million fortune went quiet Monday when he had the chance to take the stand.

No one in the Montgomery County court administrator's office or in the district attorney's office can recall juries in non-capital cases deliberating this long.
