"It was our job in Congress to make the law, and judges shouldn't be doing what we're doing because they can't be voted out of office if you don't like what they're doing". Rather than just playing it safe with a broad swath of voters anxious about access to health care and abortion, Democrats now see an opportunity to excite their base by fanning fears that the highest court in the land could turn into a bulwark to protect the man appointing its members.

On Wednesday, President Donald Trump took to Twitter to tell Democrats that if they want to have a Supreme Court pick, they should "WIN ELECTIONS!" Chris Coons said at a press conference Tuesday along with other Democrats on the Senate Judiciary Committee.

Republicans are pushing back, accusing Democrats of distorting the judge's words. "[Republicans'] new strategy is to use the court system to invalidate the protections in the law for people with pre-existing conditions", Murphy said.

Kavanaugh disagreed. He compared working at SeaWorld to playing a sport like ice hockey that comes with inherent dangers, and, unlike his colleagues on the panel, argued that OSHA doesn't have the legal standing to regulate it.

A Supreme Court fight is already a nightmare for these vulnerable Democrats. Without a doubt, Judge Kavanaugh is a threat to the most vulnerable.

But the court has moved in a different direction by other measures of diversity. "They wrote statements of opposition only to fill in the name later". "In such cases, congressional intent is clear".

The abortion issue is of particular importance this year, when women have emerged as the driving force in the Democratic Party.

The longer any final decision takes, the strategy goes, the more time groups including Demand Justice, NARAL,, Center for American Progress, and Planned Parenthood have to fire up their base and persuade their vulnerable incumbents to oppose the nomination.

And unlike abortion, defending the health law is something all Senate Democrats can rally around. And though Sen. Collins indicated this week that she finds the judge well-qualified, an aide to the moderate senator said she was not stating a position either way on the nominee. Heidi Heitkamp, D-N.D., could be a swing voter. None are strong supporters of abortion rights. Neither faces re-election this year, and both are centrists who've backed abortion rights and helped block their party's 2017 effort to repeal former President Barack Obama's health care statute.

Ultimately, neither the National Labor Relations Board nor the majority of judges on a panel for the U.S. Court of Appeals for the District of Columbia Circuit agreed with Agri Processor.
